By accessing or using the Prime Auction Solutions website (“Site”) and any related services (collectively, “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.
2. Your Responsibilities
Accurate Information: You warrant that all information you provide (including contact info, bids, payment details) is accurate and current.
Lawful Use: You will only use the Service for lawful auction-related activities; you must comply with all local, state, and federal laws.
Account Security: You are responsible for safeguarding your account credentials and for any activity under your account.
3. SMS & Messaging Program
Prime Auction Solutions operates an SMS notification program (“SMS Program”) under A2P 10DLC guidelines. By providing your mobile number and opting in, you consent to receive text messages regarding:
Auction previews & reminders
Bid confirmations and outbid alerts
Important account notifications
Message Frequency: Up to 10 messages per month, subject to actual auction activity.
Carrier Charges: Message and data rates may apply—check your plan.
3.1 Consent & Opt-Out
Opt-In: You expressly opt in by entering your mobile number and checking the consent box on our Site.
Opt-Out: Reply STOP to any message, or email us at unsubscribe@primeauctionsolutions.com. After opt-out, you will receive one confirmation message; no further marketing texts.

4. Bidding & Auction Premium
Starting Bids: Listed starting bids are guidelines; each successive bid must exceed the previous by the published increment.
Auction Premium: A 10% premium is added to the final hammer price (the “Total Due”).
Payment Terms: Winning bidders must pay the Total Due within the timeframe specified in the auction details.
5. Intellectual Property
All content on the Site (text, graphics, logos, images, software) is owned or licensed by Prime Auction Solutions and protected by copyright and trademark laws. You may not reproduce or distribute without prior written consent.
6. Disclaimers & Limitation of Liability
No Warranty: The Service is provided “as is.” We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of Liability: To the maximum extent permitted by law, Prime Auction Solutions and its affiliates shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service.
7. Governing Law & Dispute Resolution
These Terms are governed by the laws of Virginia. Any dispute will be resolved through binding arbitration in Fairfax County, Virginia, under the rules of the American Arbitration Association.
8. Changes to Terms
We may update these Terms at any time. We’ll post changes here with a new “Last Updated” date. Continued use after changes constitutes acceptance.
